1. Introduction
Welcome to Aura ("we," "our," or "us"), a quit-smoking application developed by Timon Harz. These Terms of Use ("Terms") govern your access to and use of the Aura mobile application (the "App") and related services (collectively, the "Services").
By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.
2. Eligibility
You must be at least 18 years old to use the App. By using the App, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.
3. Account Registration
3.1 Sign in with Apple
The App uses Sign in with Apple for authentication. By signing in, you authorize us to access certain information from your Apple ID account in accordance with Apple's terms and your privacy settings.
3.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
4. Use of the App
4.1 License Grant
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use.
4.2 Permitted Use
You may use the App to:
Track your smoking cessation journey
Access personalized quit plans and support
Monitor your progress and milestones
Receive notifications and reminders
4.3 Prohibited Use
You agree not to:
Use the App for any illegal or unauthorized purpose
Attempt to reverse engineer, decompile, or hack the App
Interfere with or disrupt the App's functionality
Upload or transmit viruses or malicious code
Violate any applicable laws or regulations
Impersonate any person or entity
Collect or harvest information about other users
5. Medical Disclaimer
IMPORTANT: The App is designed to support your smoking cessation efforts but is not a substitute for professional medical advice, diagnosis, or treatment.
The App does not provide medical advice or treatment
Always consult a qualified healthcare provider before making health decisions
If you experience medical emergencies, contact emergency services immediately
We are not liable for any health outcomes resulting from use of the App
Individual results may vary; the App does not guarantee success in quitting smoking
6. Data Collection and Privacy
6.1 Data We Collect
We collect anonymous usage data to improve the App's functionality and user experience. This data includes:
App usage patterns and frequency
Feature interactions
Session duration and timestamps
Device type and operating system version
Crash reports and technical diagnostics
6.2 Data Not Linked to You
All usage data collected is anonymized and not linked to your personal identity. We cannot and do not track this data back to individual users.
6.3 Sign in with Apple
When you use Sign in with Apple, we may receive:
Your name (if you choose to share it)
Your email address (or private relay email if you choose to hide your email)
We only use this information for authentication purposes and do not share it with third parties.
6.4 GDPR Compliance
We are committed to compliance with the General Data Protection Regulation (GDPR) and other applicable data protection laws. You have the right to:
Access your personal data
Rectify inaccurate personal data
Request erasure of your personal data ("right to be forgotten")
Restrict or object to processing of your personal data

7. Intellectual Property
7.1 Ownership
The App and all content, features, and functionality (including but not limited to text, graphics, logos, icons, images, audio clips, and software) are owned by Timon Harz and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
7.2 Trademarks
"Aura" and related logos are trademarks of Timon Harz. You may not use these trademarks without our prior written permission.
8. User Content
8.1 Your Content
You may have the opportunity to input personal goals, notes, or other content ("User Content") into the App. You retain ownership of your User Content.
8.2 Limited License
By submitting User Content, you grant us a limited license to store and process your content solely for the purpose of providing the Services to you.
8.3 Content Responsibility
You are solely responsible for your User Content and warrant that it does not violate any third-party rights or applicable laws.
9. Third-Party Services
The App may integrate with third-party services (such as Sign in with Apple). Your use of these services is subject to their respective terms and conditions. We are not responsible for third-party services or their content.
10. Subscription and Payments
10.1 Subscription Plans
Aura offers the following subscription options:
Monthly Plan: €9.99 per month
Yearly Plan: €44.99 per year
10.2 Payment Processing
All payments are processed through the Apple App Store. By subscribing, you agree to Apple's payment terms and conditions.
10.3 Auto-Renewal
Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You will be charged the subscription fee for the next billing period within 24 hours before the current period ends.
10.4 Free Trial
If we offer a free trial period, you will not be charged until the trial period ends. If you do not cancel before the trial ends, your subscription will automatically begin, and you will be charged the applicable subscription fee.
10.5 Cancellation
You can cancel your subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period. You will retain access to premium features until the end of your paid period. No refunds will be provided for partial billing periods.
To cancel:
Open Settings on your iOS device
Tap your name at the top
Tap "Subscriptions"
Select Aura and tap "Cancel Subscription"
10.6 Refunds
All sales are final. Refund requests are subject to Apple's refund policy. To request a refund, contact Apple Support directly through the App Store. We do not have access to process refunds for App Store purchases.
10.7 Price Changes
We reserve the right to change subscription prices at any time. Price changes will not affect your current subscription period but will apply to future renewals. You will be notified of price changes at least 30 days in advance. If you do not agree to the new pricing, you may cancel your subscription before the price change takes effect.
10.8 Access to Features
Premium features are only accessible with an active subscription. If your subscription expires or is canceled, you will lose access to premium features but may continue to use any free features of the App.
11. Termination
11.1 Termination by You
You may stop using the App at any time by deleting it from your device. You can request deletion of your account by contacting us at oneboardhq@outlook.com.
11.2 Termination by Us
We reserve the right to suspend or terminate your access to the App at any time, with or without notice, for any reason, including violation of these Terms.
11.3 Effect of Termination
Upon termination, your right to use the App will immediately cease. Sections that by their nature should survive termination will remain in effect.
12. Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT:
The App will be uninterrupted, secure, or error-free
The results obtained from the App will be accurate or reliable
Any errors in the App will be corrected
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TIMON HARZ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:
Your use or inability to use the App
Any unauthorized access to or use of our servers
Any bugs, viruses, or other harmful code transmitted through the App
Any errors or omissions in any content
Any health outcomes related to your use of the App
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR €100, WHICHEVER IS GREATER.
14. Indemnification
You agree to indemnify, defend, and hold harmless Timon Harz and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
Your use of the App
Your violation of these Terms
Your violation of any rights of third parties
Your User Content
15. Governing Law and Dispute Resolution
15.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of Germany, without regard to its conflict of law provisions.
15.2 Dispute Resolution
Any disputes arising from these Terms or your use of the App shall be resolved through:
Good faith negotiation
If unresolved, through binding arbitration in accordance with [Insert Arbitration Rules]
As a last resort, through the courts of Mecklenburg-Western Pomerania
15.3 EU Users
If you are a consumer based in the European Union, you have additional rights under EU law, and nothing in these Terms affects your statutory rights.
16. Changes to These Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by:
Posting the updated Terms in the App
Updating the "Last Updated" date
Sending you a notification (if applicable)
Your continued use of the App after changes become effective constitutes acceptance of the revised Terms.
17. General Provisions
17.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App.
17.2 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.
17.3 Waiver
Our failure to enforce any right or provision of these Terms will not constitute a waiver of such right or provision.
17.4 Assignment
You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.
17.5 No Agency
Nothing in these Terms creates any agency, partnership, joint venture, or employment relationship between you and us.
